As you told in you problem is there is that much difference and if you feel you family atmosphere could not return as it was early then you can go for divorce.

As you told you husband is sending back to you and in other side you are ready to live separately, then go for divorce on the ground of mental cruelty. Because the reasons coated in the above problem is itself a ground for mental cruelty. .

You can proceed with divorce and also you can seek for maintenance.

Madam in this case file a case for domestic violence and you can stay in the same house separately, or you can ask for alternative accommodation, further you can ask for maintenance for your self and your children, further you can get protection orders to restrain your husband not to communicate with you or stay away from you and all required reliefs are available under domestic violence act so you are required to file a case of domestic violence which is applicable to all.

Dear Madam,
If you want get decree of divorce, you have to file a suit for decree of divorce and permanent alimony on cruelty ground before Family court, after conducting normal procedure, court will pass an order.
