How to evict husband from property

an old (55) lady wishes to throw her husband out of the house as he is in adultery. what is the surest and fastest way to evict him? she has only one daughter who is 35.

Many ways you can evict your husband. you can filed civil as well as criminal case. without full information and without document no body can help you. Firstly you approach a lawyer then you get remedies.

If property is in your name you can debar your husband from property,in addition of this you can file Criminal complain against him under ipc but you can't debar your husband from his personal or ancestors property

The best way to go about this is to file a petition under Section 12 of the Domestic Violence Act. An injunction can be prayed for from the court subsequent to which the dispossession orders can be received. Also, if the house is in the exclusive name of the wife, then a Suit for Possession can be filed against the husband which will definitely succeed as Adultery is already taking place. A criminal complaint can also be filed under Section 497 of the Indian Penal Code, 1860 thereby asking the concerned Magistrate for the relief of summoning order against the husband accused by bringing on record the relevant evidence of Adultery which I am sure the wife would have by now.

Eviction, very soon, won't be possible. If the husband is in adultery then the wife concerned will have to file a petition for divorce on grounds of adultery among st others. Also, the property in question if belongs to the husband, then eviction will further be a problem.
