How much maintenance can I ask from my husband after divorce

sir my husband want divorce from me. he has an affair with other girl and always force me to file divorce papers. our marriage is 28 months old and we had a baby of 15 months. want to know after divorce how we will survive. how much maintenance we get from my husband for me and my daughter. what are the liabilities of my husband regarding us. i am not working now bcz my daughter is too small. so plz tell me about maintenance amount i will get after divorce.

It depends on your husband's earning capacity. If you go for Divorce by mutual consent then you can go for wholesome settlement for yourself and monthly maintenance for your daughter. Since he is the one who asks for Divorce let him pay the maintenance what you desire but before that make sure that you are ready for Divorce. Because if he forces you to leave to your parents house then without giving Divorce also you can claim maintenance and you have a good case since you are not employed now. Good luck.

Hi ma'am. You can file a divorce petition in which you can ask for maintenance and/or alimony. The income of your husband will play a major role. He will have to maintain you and his daughter. Please get in touch for further details.

There is no straight jacket formula for calculating for mentinance but it all depends on the circumstance of each case . Here the nature of work, income of your husband his dependency and other factors plays roal.
