Child Visiting rights during interim maintainance order

My wife along with child is living separately from past one year due to marriage conflicts. she is also making false allegation of disputes in her lawyer notice for reason of living separate with me. She is also not allowing me for access of child visitation. if she file petition for interim maintainance which I am ready to give as per court order then can court also pass order of child access visitation at same time of interim maintainance order instead of filing separately for child access petition/custody by me.

No! Interim maintained is different as u thinks, first of all interim maintainance is subject of claim by deserted and dependent woman, in ur case she is having custody of your child, one or other context you are the person who is at loss, now solution is, hire a competent lawyer, file a access petition in family court, you can file application for access in maintainance case also but court is not bound to decide the same, therefore it will be better to file a separate petition.

You have to file application seeking day ,time,place,period of time , of access of your child with you also seeking temperory custody once in two months for a day ,where you can take him to garden,movie,or picnic,.beside during vacation a custody for week for outstation visit .
