Can mother take child abroad without father's consent

Post divorce can a mother take her child and work abroad for the sake of maintenance of self and child? What powers does the father have with regard to objection? (grounds for divorce : alcoholism and mental agony and cruelty)

You file a suit for protection and get back, and you need to contact and discuss more to file a divorce case for mental cruelty and other ground etc., consult more and get relief. Immediately take care of your child while filing suit.

If the child is in your custody and if there is no orders from the court that you should not take your child abroad, then you can take your child with or without consent from your husband.

Ans: it depends on the visitation rights of the husband. if he has visitation right every week, then it would be difficult. however even if you violate, you can plead the same in case there is a petition for visitation or its violation. nobody can be prevent you from going abroad.

If you have obtained permission custody of the child from then you can take the child to abroad. The grounds for divorce urged by you may not be sufficient and strong. Working at abroad and continuing legal fighting in India is difficult. Try for mutual divorce.
