Can I speed post my written arguments to the court ?

15-Dec-2023 (In Divorce Law)

My case is fixed for ex parte written arguments. The case is being adjourned since long and i feel very harassed. On last hearing also the argument was not taken by the court. Can i in this case speed post my written argument to my court.? And leave it on the court for what ever decision the court may take. What will be the legal consequences in such case.? Can my divorce case be dismissed? Or having speed posted the argument I can take up this matter to HC.? Kindly guide with supporting legal provision or legal judgement

Hello you cant send your arguments by speed post. Rest, it depends upon you that what you want. You want divorce or not? If you dont appear then the H'nble court will give decision according to the facts. Advice you to get in touch with one of the lawyer and discuss your matter in detail. So that the better advice can be given accordingly.

Actually if the court proceeds exparte then you go for setting aside the eparte order. Otherwise court will not entertain the party who has been proceeded exparte. In law there is no provision prohibitting you to post the written argument, if you want to file written statement no one can stop you. But it is upto the court where it is going to peruse the content of written argument or not. Even otherwise also court has to decide the case on merit.

no you can not do this because their is law that you can't send by speed post but in that circumstances there is problem if it is not delivered to the court that gave you problem you can go to the court and give it the court Ahlmad your written statement automatically come on the record and after that you move an application for early hearing this will give you better than the speed post.
