Can husband take cruelty as ground for divorce

my brother is into very harsh married life.just continuing because of his five year daughter facing mental harassment regularly by his wife for almost every small thing.fed up by her short tempered rude behaviour. can this be the ground for separation.?. how to get our of it and take child custody.. pls guide
harassment whether mental or physical is a ground for separation provided you prove the same in a court of law. regarding custody of child, there are lot of aspects are involved, as to who will give better education and comfort to the child i.e. the father or mother and to whom the child has more affection etc.,

Yes their are grounds of divorce as well as separation for cruelty meted to any partner and hence it has to be executed well and under good legal appraoch , yes under such circumstances even child custody can be given to father if mother is not able to look after ,approach us,OFC : Adv Pankaj Kumar & associate..

Cruelty either physical or mental is a valid ground for divorce. Your brother can file for divorce and obtain a decree from the court. You can also move an application for the child custody.

sir, in this case it is better that your brother keeps the child with him and file a divorce case on ground of mental cruelty and further in the divorce Petition mention that the custody is with your brother so that if at all she wants the custody of child then let her fight it out in court, and yes cruelty is a very good ground for divorce.
