Can divorce be filed if wife is abusive and non cooperative?

Filing divorce by husbands these days are acting as a boomerrang and making life of husbands more miserable. But yes that does not mean there are no ways out. First gather strict proof of the fact that your wife doesnot want to stay alongwith your parents and wants separate accomodation with you. A lot of planning needs to be done before she will compel herself to move out or file divorce herself.

You can get divorce only if the marriage was under Special Marriage Act. you did not take benefit under Muslim Marriage Dissolution Act. So, I think you wife now converted Muslim from Hindu, though I am not sure. But if she conveted from Hindu to Muslim, then there is a way by amicable settlement with her and you can take divorce.

In all Hindu Marriage Act and Special Marriage Act & other marriage laws, there are provisions of divorce on d ground of mental & physical cruelty as well as desertion too. If any spouse is aggrieved of rude attitude & suffered from abusive words and irritating behaviour of another , u can seek redressal through marriage /divorce laws.
