How to withdraw a case filed under section 498A?

19-Dec-2023 (In Criminal Law)
Have filed a case against my ex-husband under section 498A. However, I wish to withdraw the case now as we have mutually agreed for divorce and the consent terms have been signed in front of the family court judge. The judge has not yet passed the decree which would happen in a month's time.

You will have to file writ petition in hih court for quashing of the criminal case.

There is no procedure under the criminal law where section 498A case can be withdrawn as it is not compoundable case.

You can Give it in written to the police station where you have given the complaint and appear before the magistrate to make the statement for withdrawal. In your case when you appear before the court after settlement you can ask you lawyer to make request to the court for the same . The court will order the enqiry officer and the you can go nd sign the documents when call by the officer
