how to apply for custody of child

I stay with my parents seperate from wife. Not divorced, Hindu. My wife leaves alone with my son, 7 years now. When I left, I took my son with me at his consent, but my wife took him back with help of police. I find my wife is not taking care and education is being hampered. Can I take custody on this ground?

You are required to file custody case under Guardianship ward Act read with Hindu minority act at AP matrimonial court where the child is residing.

You can also file an application under section 12 of the Act for seeking temporary custody of your child

you can pray for custody of your son on the above mentioned grounds of yours. You have to file a petition before The Learned District Judge of your jurisdiction and there from you can get the order of custody of your son.
