Received court summon to repay the cheque bounce amount what can i do.

I had received a legal notice to repay the amount of 5.5 lakhs borrowed from my friend as my cheque had bounced due to my account being closed. I didn't bother to reply to it. Today I've received the summon from court to attend the court in Jan. Since am currently unemployed single parent, i can't repay any money to the borrower. Am looking for suggestion to relieve me from this case. Please suggest.

It is a cheque bounce case under Section 138 of Negotiable Instruments Act. You have committed a criminal offence. You have only two options - (a) to repay the entire amount to your friend and make him withdraw the case (b) face the case by taking bail on the next date of hearing.

Dear Querist,
Since u r a single parent you have to be little more careful, now that u have not issued a reply to the notice denying the allegations, u can now defend u r case by filing an vakalath thro an advocate else u run the risk of getting a NBW against u for arrest if u dont appear in the first hearing in Jan. Thereafter, u can either defend u r case or settle the matter seeking some time.
