Junior getting more salary then me can I take legal action?

Sir I m army havildar,and my junior in same trade grade taking more pay. Last four yr i doing official correspondance but no result till time. What can i do....i don't know what is the procesure of court case.

Hi,

As per seniority, you must get a higher salary than your junior. You need to file a statuary petition under provision of Army Act. If you don't get a suitable reply within 45 days, you may file a case in Armed Forces Tribunal.

It is not permitted that a junior draw more pay than senior, in some cases it happens during refixation of pay due to promotion, upper slab or after implementation of pay commission. It also happens due to a choice of arrears after pay commission implemented, if a person filled up the wrong choice and obtained more arrears and chosen the wrong fixation of the pay scale. It can be corrected within a time span. If you have already written to the authorities and do not find respond you can challenge this in AFT. Regards
