Can eviction be done by arbitration
25-Jan-2023 (In Arbitration Law)
I want to know that can I get my property evicted by process of Arbitration.
If your rental agreement have the arbitration clause then you can initiate the arbitration proceedings to evict the tenant from your property. In case, your agreement have not mentioned about the arbitration clause then you have to approach the rent control court to evict him.

Hi,
As per the decision of the SC in Ranjit Kumar Bose's matter, the relief of eviction can only be granted by the 'Civil Judge having jurisdiction'. Sec 6 of the Tenancy Act deals with this and thus eviction cannot be granted by the Arbitrator.
