Rape By My Boy Friend In A Hotel

04-Apr-2025 (In Women Law)
I had a consensual physical relationship with my boy friend but he engaged somewhere else. I filed a rape complaint against him in a nearby police station but they did not register my FIR on the grounds that I'm married. After that me and my boyfriend compromised and he agreed to marry me. One day he took me to a hotel said that his mother wanted to meet me as he's from some other state so I agreed to meet his mother in a hotel. We went to hotel and he said that his mother was on the way and about to reach. We kept waiting. After a while he offered me food and drink. After drinking alcohol made physical relationship with me. When I came back to my senses i realised that I had been raped. I immediately called the police to the hotel . Now police are favouring him and the IO is saying that it can't be rape where I went to hotel with my own free will and we were about to get married. Can he a get conviction of my rape. How much is my case strong?

Filing an FIR under Section 376 IPC (Rape) intoxicated and unable to give valid consent, it can be argued that the act was non-consensual. file a written complaint at the police station and insist on registering an FIR. If the police refuse, you can approach the Magistrate under Section 156(3) CrPC to direct the police to register the FIR. Medical and Forensic Evidence If the incident was recent, you should immediately get a medical examination at a government hospital to record any signs of intoxication or forced intercourse. Hotel CCTV footage and staff testimony can also serve as evidence. Filing a Case for Cheating (Section 417 IPC) and Criminal Breach of Trust (Section 406 IPC) If he falsely promised marriage to deceive her into a relationship, you can file a case for cheating and breach of trust. Gather Evidence, Hotel records, CCTV footage, call and message history, and any past promises of marriage via text or chats. Witnesses (hotel staff, friends, or any person aware of his promises). Medical and Psychological Reports

You should immediately file a complaint in writing and address it to the police station according to your jurisdiction and then after taking the DD number you need to approach the court under section 156(3) CrPC for registration of FIR against him. And this all comes into the crime of rape only.
