Questions Answered by Advocate Mehak Bhatia

Q: Special Marriage Act, 1954 issue

Briefly, what is the process to get our marriage registered in India under the Special Marriages Act? I am an Indian citizen (Hindu) getting married to an American citizen (Agnostic) in India on the 9th of June, and we both normally live in Australia. As I understand it, one of the requirements under the Special Marriages Act is that at least one of the people getting married is resident in the district the marriage is registered in. Noting that I will be travelling to India for a few days over Easter break (16/17 April), both of us will only return to India to get married on 28 May. We have tickets to return to Australia on 22 June. Additionally, I will be living in Gurgaon while the wedding ceremonies will take place in Agra. Is there any way we can register the marriage in India despite the fact that neither of us will be resident for 30 days? Also, is it an issue that we’ll be living in Gurgaon and getting married in Agra? What is the evidence we need for the residency

Advocate Mehak Bhatia answered

Q: FIR quashing steps & process before 2nd motion

We agreed and mentioned in the MOU that we will File the FIR quash before 2nd motion of Mutual divorce. And first motion is completed and 2nd motion is scheduled for the 1st week of April. Now, my Advocate is suggesting to file the FIR Quash after the 2nd Motion and he will file the quashing with the Divorce decree. Otherwise, the High court can either reject the application or the case dates will be extended as if we go before the 2nd motion then the next day of the hearing will be very late. And the Quashing case will be extended and also there is a risk of the High court can levy the fee (penalty).I am looking for an honest response. What should be the best action to be followed? And suggest whether above points told by my Advocate are true?

Advocate Mehak Bhatia answered
yes you can get the fir quashed only before th hon'ble high court of your state. kindly contact us for further clarification.thanks and regardsAdv Mehak Bhatia Legalklick & AssociatesCoFounder Delhi High Court & District Courts
