Can I File Under BNS 69 If My BF Again Broke My Trust

19-Apr-2025 (In Women Law)
I had a consensual physical relationship with my colleague on the promise of marriage and he got engaged somewhere else, I filed complaint against him but police didn't take any action because I was not divorced that time although I had been living separately from my husband. My bf accepted his mistake in front of police and promised me to marry and said that his engagement had been broken. After my divorce he proposed me for marriage and made physical relationship with me, infact his family asked me to marry him. But again he got engaged with the same girl whom he had engaged earlier within 3 months of promising me.Now can I file a fresh BNS 69 case against him ? He'll be convicted or acquitted? How strong is my case?

You may have a valid case under Section 69 of the Bhartiya Nyaya Sanhita, 2023, which penalizes sexual relations obtained through a false promise of marriage. Your ex-boyfriend repeatedly made promises to marry you, even involving his family, and continued a physical relationship with you after your divorce. His actions show a pattern of deceit and lack of genuine intent to marry. If you have evidence like chats, messages, or proof of his family's involvement, your case becomes stronger. A fresh police complaint can be filed detailing the sequence of events and broken promises. The success of the case will depend on your ability to prove his false intent and misuse of trust.

You can always file a petition under section 156(3) CrPC for registration of FIR against the culprit. The culprit will be guilty under section 64 and 69 BNS. For more legal assistance I am just a call away.

Section 73 of BNS (Cheating) – If a man dishonestly induces a woman into a sexual relationship by falsely promising marriage with no real intention to marry. Essential Ingredients to Prove: There was a promise to marry. The promise was false from the beginning (i.e., no intention to fulfill it). The woman consented to a sexual relationship based on that promise. There is supporting evidence: messages, photos, witnesses, etc. your case is very strong
