Do I get any rebate as my husband is dead I am not earning

Hello My husband has died on 24/01/2016 He has sell his property last year in June 2015 and purchased new property in July 2015 Now i have to pay capital gain tax on balance amount which has left but below are the complication (i)Money on which capital gain tax is thier has left is in joint FD with his brother and his brother is now claiming that FD belongs to him as it is either or survivor (ii)Do i get any rebate as my husband is dead and i am non earning senior citizen

On what amount exactly you are expecting a what has not Bern mentioned by you. I am sorry for your loss but unfortunately such compassionate grounds wouldn't be able to get a rebate for you. As far as the capital hain tax liability is concerned in you case that would be on the person who is claiming the amount so received which is not you. So your husband's brother would be liable to pay the capital gains tax
