Received an Arbitration Notice from a Delhi Lawyer for a NBFC

19-Jun-2024 (In Recovery Law)
I have received an Notice of Arbitration Proceedings from a Lawyer in Delhi on behalf of nbfc. I missed my 1st emi this month after paying my emi regularly for 24 months. Got calls from collection agents and the head of collection area manager threatening to get my cheques bounced and get my account seized and send recovery agents to my home to intimidate my parents. I have already informed the nbfc of my current financial hardship. What can be done in this case and what should be my response ?

If you have received a legal notice and want to go legally then you must reply to the said legal notice mentioning your inability to pay off the loan amount and also suggest them about some settlement amount which you can offer to totally close the case. For more legal assistance I am just a call away.

Keep on communicating the banks for your financial hardship and request them to alter your EMI. Even if they deny, youu may still send whatever you can into your loan account from online or upi transaction, attract a screenshot of the same and email to the bank that because of your hardship you were only able to pay the said amount. You may also write a letter to the Arbitrator apologizing for your missed proceedings stating reason and request for another date to be communicated to you. Please remmeber the bank will pressurize you so much that, they want you to settle the matter. You may settle the matter and negotiate with them, there are chances you end up paying less. If you aren't able to settle and need time, the only option is to go to court. The court will at least take a year to reach out to you and send you notice, say every 3 to 4 months, most likely, the Petitioner or the bank lawyer's will miss to serve the process necessary to send you summons through court. In that case as well you may not go upon receiving first or second summons and keep tracking the orders uploaded online. When you sense that last warning is given to you for appearing in the court, then you may turn up but also be prepared for a genuine answer along with proofs why you didn't recieve summons and why you weren't able to come to court. Also when your financial status is okay you may try to negotiate while proceedings.
