Need help in recovery of money

19-Feb-2023 (In Recovery Law)
My friend borrowed money (online transaction) on the pretext of returning the money in a week and now it’s been almost 98 days and there’s no proper response on when the borrower will return the money. Borrower’s family started abusing & threatened us not to involve anyone in this matter else the money will never be returned. After much trouble one of borrower’s family member gave us a post dated cheque (is not from borrower’s account) that has bounced. Till now there’s no guarantee of when will we get our money. We get calls from borrowers family with abuses and threats if we try to reach the borrower in any way (call or msgs or in-laws). When we tried reaching relatives of borrower we were informed that if anything happens to borrower due to stress we will be in trouble & borrower never took the money for own use but borrowed to help another family member hence borrower is not responsible to return the money back. Please help with next steps. Thanks in advance.

you can file case for cheque dishonour within the limitation under law against them , so that you can fight against him in court for recovery or settlement other than that you can file cheating case but you can't recovery money in that .

Kindly send notice to the person who issued the cheque and also to the borrower separately and thereafter file a civil suit for recovery of money against borrower and dishonor of cheque case against person who issued the cheque... If they threaten lodge a police complaint after sending legal notice

first you issue legal notice to borrower demanding of money advanced through online and also you collect transaction details from your bank, if borrower failed to repay the same then you file recovery suit where the transaction took place or where the borrower resides, but you have to pay court on recovery amount
