Your lawyer is not fully correct. Even if the loan was advanced when both parties were in the UK, Indian courts can still have jurisdiction because both of you are now residing in India and the obligation to repay is continuing in nature. WhatsApp chats where the borrower admits liability or promises to repay are valid electronic evidence under the Indian Evidence Act if supported with a certificate under Section 65B. These messages can establish existence of a debt. You can issue a legal notice from India demanding repayment. If payment is not made, you may file a civil suit for recovery of money under Order 37 CPC (summary suit) or a regular recovery suit in the court where the defendant presently resides in India. Additionally, if there was dishonest intention from the beginning, a criminal complaint for cheating under Section 420 IPC can also be considered in India, since the effect of the offence is being suffered here. The limitation period is 3 years from the last written acknowledgment or promise to pay. Do not delay, as jurisdiction is not barred merely because the transaction happened abroad.

Since both parties are now in India, you can file a Summary Suit under Order 37 of the CPC where the defendant resides. WhatsApp chats and bank transfers are valid evidence in Indian courts as per the concerned provisions of law.

Yes, you can still try to recover your money. Even if the payment was made in the UK, since both of you are now in India, you can file a civil recovery suit in India based on WhatsApp messages as proof. Courts do accept WhatsApp chats as evidence. If Indian courts refuse jurisdiction, then the only option is to file a case in the UK. So the money is not lost, but you must take proper legal steps in the correct court.
