Financial or health difficulties do not automatically suspend a housing-loan EMI obligation. However, you may immediately approach the lender in writing seeking temporary moratorium, EMI rescheduling, restructuring or extension of the repayment tenure, supported by relevant medical/financial documents. Do not ignore notices or allow prolonged default, as penal charges and recovery/SARFAESI proceedings may follow. If the lender refuses reasonable restructuring, the available legal remedy depends on the loan documents, stage of default and notices received.

You should immediately submit a written request to the bank/lender explaining your financial and health difficulties and seek temporary relief such as EMI deferment, restructuring, rescheduling, or reduction of the EMI. Attach relevant medical records and documents showing financial hardship. However, merely being unable to pay does not automatically create a legal right to an extension, and continued default may result in interest, penal charges, adverse credit reporting and recovery proceedings. If the lender rejects your request or initiates recovery action, the loan agreement and notices should be examined to determine the appropriate legal remedy.
