Preserve Evidence Download and safely keep: • Bank statements of both transfers. • WhatsApp chats where repayment in ₹30,000 instalments was promised. • Screenshot showing receipt of only one instalment. These electronic records are valid under Section 65B of the Evidence Act. 2. Send Legal Demand Notice Issue a legal notice demanding the entire outstanding amount within 15 days. Mention dates of both loans, mode of payment, written WhatsApp commitment and default. This creates a formal cause of action.

Since the loan was transferred through bank channels and there is a written repayment assurance on WhatsApp, you have strong documentary evidence. First, issue a legal notice demanding repayment within a fixed time. If unpaid, you may file a summary suit for recovery under Order XXXVII CPC. You can also lodge a criminal complaint for cheating (Section 318 of BNS) if dishonest intention is apparent. WhatsApp chats and bank statements are admissible evidence. If any cheque was issued and dishonoured, proceedings under Section 138 NI Act can also be initiated.
