Friend's room partner used my credit card and not paying money now.

10-Jun-2023 (In Recovery Law)
Hi, Good Morning!! A friend's room partner used my credit card and is not paying the bill. He borrowed the card to use for 60K but used it for double amount without permission or intimation. He was always promising to pay in one month but never paid. I had to go for settlement and paid the amount to bank. After that also I have been following him for my money and he has paid some amount and still 70K is not paid. I have recordings of what he has said to me on phone where he says how he will make the payment. Beside, he has also given me a written note signed by him that he will pay the amount outstanding. Now, he is not picking up the call. Please suggest, if the amount can be recovered and if yes How? Also confirm how much fees you will be charging for this help. Thanks & Regards,

I advise you to file a civil suit for recovery and tell me if such payment was being by him in lieu of his expenses ? If yes then he is certainly liable to pay back each and every penny. That can surely be recovered through a suit of recovery. Fees can be talked about on phone as I have not been allowed by this platform to advertise my fees here.

You must first send a legal notice and then if required filed a criminal complaint and / or a civil suit. Alternatively, pre-litigation mediation can also be attempted. The note helps you a lot. Yes, the amount can be recovered. Professional fees only on personal request.

Hmm in your case, need some details about the place of transaction done ,. And when he had taken the amount, Also need to know that you have some written arrangement for the same or not. You can go for civil recovery in this case,

you can go on with filing a proper case against him , but that would add to your expenses and cost. hence, instead first send him legal notice which shall work as a formal warning for him. a formal legal notice calling upon him to pay the amount WITHIN 15 DAYS or else you will move to the court. then , if he does not act/ react upon the same, you can go ahead with filing a formal recovery suit against him.

I suggest you to harass and threaten him by sending him a legal notice. He would definitely return your money back within the time mentioned in the legal notice. Don't delay this process as if you delay he will never return back your money.
