Friend borrowed money how can i recover it

One of my friend take money from me and promise me to return the money in next 6 month but now after 2 years he is still not giving my money back. I have transfer 4 lakh into his account through RTGS. its the only proof I have. he is saying he will give but not giving back. Please suggest me option of 420 case , can I file the case on the basis of bank transfer . Any other option

issue a legal notice to your friend then file a recovery suit based on the RTGS transaction the possibility of 420 case is less but civil remedy to recver the money along with interest is maintainable in your case,

You may file suit for recovery of money in the appropriate court of law after paying the requisite court fee, which depends on the amount of money taken by your friend on loan . Civil litigation, especially recovery suits generally termed to be a long drawn battle and regarded as something best avoided, is not so. The general belief that by filing a recovery Suit against a Debtor will go on for years at large, is not so, if one knows the real scope of Order 37 of the Civil Procedure Code, 1908. You may engage a good lawyer to this effect.

Yes, you can file a case against the borrower as well as get the amount recovered from him along with interest. The proof of RTGS is surely a very good proof. You can also get a cheque issued in favour of you as a surety. But remember that a cheque is valid only for 3 months.

yes you can file recovery suit against your friend on the basis of bank transfer. regarding 420 and other criminal case i will have to discuss it personally. if possible you can come to my office to discuss the matter in details then only i can advice you properly.
