What to do when I am not getting rent for part of ancestral property

08-Jul-2023 (In Property Law)
Hi...i am a resident of faridabad and have my own house there...recently i hv bought a new home in delhi and shifted there..the house that i owned in faridabad is in a village...the whole house is divided into 4 parts 3 for my uncles n one for my father...however this is not on papers...as its a village so the decision is taken amongst some elderly people and family members...We also own some rooms which are on rent.We are two brothers. As i have shifted to delhi...now my parents are refusing to give me half the rent..as was decided earlier...before i left the house. Also they are refusing to give my part of property to me...i had locked my room where i lived..and i visit there often..What should be done..? I feel that i should legally take my part...so that there would be no problem afterwards...but i have no idea what to do...m under loan and hence need rent for day to day activities..and also would not want to loose my share of property. However this whole property belongs to my ancest

you say that Faridabad house is owned by you. please do share your right/capacity of ownership over the property in question. Did you buy the property? but in last sentence you say it is an ancestral property. if it is so, then you have no right in the property till your father is alive as on demise of your grand father, your father became absolute owner of the property along with his other siblings and mother, to the exclusion of others, including you. So, you can only have a right in the property with the permission of your father.
