What to do my brother sold property belonging to my father

sir there is a property belongs to my father the entire one acre my brother sold away the claimant(cl) i file a civil case against claimant for some days claimants wife sold away my share by showing wrong boundaries they are constructing a poultry shed in our property our advocate is telling that we cant get stay order please give need full advice my advocate is saying that our judge wont give stayorder until preliminary decree has given to regards
A stay order can be taken under order 39 CPC for temporary injunction injunction. This would prevent any further construction on the property and restraint against creating any third party interest while the suit is pending between the parties who are in dispute over the said property.
