Want to know the procedure of transfer of property in blood relation

TWO REAL SISTERS MARRIED IN A SAME FAMILY AND ELDER SISTER IS WIDOW. SO KINDLY PROVIDE ME INFORMATION THAT HOW SHE (WIDOW) CAN MAKE A WILL FOR GIVING ALL HER PROPERTY TO THE YOUNGER SISTER. WAITING FOR YOUR RESPONSE.

As per section 123 Transfer of property act ..Transfer how effected For the purpose of making a gift of immovable property, the transfer must be effected by a registered instrument signed by or on behalf of the donor, and attested by at least two witnesses. For the purpose of making a gift of movable property, the transfer may be effected either by a registered instrument signed as aforesaid or by delivery. Such delivery may be made in the same way as goods sold may be delivered.

The widow sister can transfer her property by a registered gift deed. She has option to execute a will also in this regard. If the property belongs to same family, she can allow for mutation in your favour, by filing an application before concern authorities .

Elder sister can make will with respect to her share in the ancestral property in favour of anyone including her younger sister. She can also make a will with respect to her self acquired property.It is better advisable that get the will deed registered.

Some facts are needed to be addressed before getting widow's property transferred. Such as wether property is under the name of widow. Whether widow has any children. It is better to contact a good lawyer, apprise him about all facts and act accordingly as per his advice.

If elder sister is no child then she can give on own property to younger sister by wil & gift. Younger sister.wil be file to probate in the court after death his elder sister but gift is already valid after death of elder sister
