Sister Right in father's Property

My Father Dies in 2003 and my mother still alive and after my father dies we had made a partnership deed in which 50% partner is my mother and 50% is in my hand. Nowadays my sister blackmails me that they want their share. Please tell me if we don't sell this property then also they can demand their share and if yes then for how many shares they are eligible

Do let us know whether the property of your father was ancestral or self acquired. Do also let us know whether he died leaving a Will or Without Will. In case it's a self acquired property of your father your Sister will not have any right in the property, however in case it is ancestral than your Sister will be entitled to equal share. as i have read ur problem here on lawrato.after death of ur father u and ur mother together decided yo take over the over all property.as partnetship deed of 50 % each .but now ur sustrr is asking her share with you and your mother. as well as she is also trying to blackmail you people you need to taoe legal steps for this pourpose. to get the matter solved.

Hello Sir I have perused your query. In case your father died intestate or without any will in respect to the property then the property will devolve equally upon all his legal heirs or in your case, upon the 3 surviving legal heir I. E. 1/3 share with everyone- you, your mother and your sister.

this depends on the fact whether your father dies intestate or he had a will. your sister is entitled to a share if he dies intestate. your sister can demand her share even if you don't sell the property by filing a suit for partition.
