Schedule of assets for my Mother's Succession Certificate

09-Oct-2023 (In Property Law)
My Mother was holding some shares jointly with my father.Mother expired in year 2006 and father expired in 2009. I am asked to obtain succession certificate from High court to get the shares transmitted in my name. Kindly advise on whether the details of my Mother's shares should be covered in the schedule of assets of my Mother's succession certificate or that of my father's succession certificate.

This is my response to you:
1. Unfortunately since it was jointly held by them you will have to obtain succession certificate for both of them;
2. This is an advantage for you as in the future if you believe that, some of your mother's or father's assets were not transferred to you, then you can use this succession certificate in the future occasion as well;
3. So apply for both of theirs and do the needful;
4. In the meantime also obtain legal heir certificate from the taluka office as well;
5. Consult a local lawyer and take legal steps.
