Property gift deed and GPA clarification

Hi Sir/Madam, My father had bought a property in 1987 which was not registered and had Done GP on his name which says he has all rights eg: to sell, construct etc.. we constructed home on that plot in year 2000 and are in possession since then. Have electric bills since year 2000 and we have water bill and tax paid papers from 2008. my dad passed away at 2010 after which my mom as a legal heir registered the property on my name. now the land owner is fighting with us to pay 20 Lakhs saying the property doesn't belong to us. What can we do. can we win the case if we go to court since we are in possession since year 2000 . and have all bills on our name?

If your father was a GPA holder how can your mother register the property in your name? GPA holder is not a owner of the property. Option before you is to claim adverse possession against the real owner.

It appears that you have just kept the GPA with you and did no registration. You are also not telling whether the GPA was a registered one, and whether the same person is demanding money from you or his heirs. You have one obtained any title over the property. I have a method to solve this, but one wrong move by you and You will lose the property.

sir, It is not a good case to fight against the land lord. Ignorance of law is no excuse. in your case without verifying the document is not better to suggest. sorry for incomplete answer due lack off materials in the question.pl consult.

As you told. You are in possession of property since from 1987.

As you told the you father brought the property under GPA. After the death of your father the GPA automatically canceled.


Sir, GPA does not give the owner ship over the property. You can go for court for claiming the amount that you have invested over the property from the date of possession.

In your issue you dose not informed that how your mother registered the property in your name( Mode of Transfer). I hope GPA may contain the clause that After the Sale, agents duty.

You are not also informed that how your mother acquired the right over the property to transfer the same in your name.

In case if they came for settlement, please proceed for settlement.
