Procedure for Stamp duty and Registration charges on covered garage.

I have bought a new flat alongwith a covered garage. In the sale deed, the super built area of the garage is mentioned as 100sqft while the stamp duty for the same is arrived at by considering the area to be 135sqft. When I asked the developer about the discrepancy, he said to me that Government doesn't allow garage registration below 135sqft. Is it correct that Government doesn't allow garage registration below 135sqft?

Yes it is so.In finding the query or valuation ..there is no option below 135 sft..and minimum size for a garage is 135 sft.so u can get the registration done and u r not being misled.But pay for only 100 sft.

As per kolkata municipal corporation act 1980 the area of garage should be 135 sq. ft and the same should be covered garage. no open garage unless open garage is sanctioned by kolkata municipal corporation. so tgis is the rule and law

No, this is wrong. Government generally takes 20% of the covered area as added area. The super built up area will be 100 SQFT carpet area +20 SQFT= 120 SQFT Super built up area. I think the developer has charged 35% over the carpet area. You can ask for legal explanation in writting for the 35 SQFT. If he makes any annoyance , you can move to the consumer forum for settling your grievances.
