Need Assistance regarding family property

01-Jun-2023 (In Property Law)
I am 44 yrs old lady, we are two sisters . I dont have good terms with my parents. I am not expecting any good posibillities in terms of there help to me from there property, I mean will they give all the property to my younger sister. As this is my second marriage , I am raising my kids from first husband all alone, its just a compromise sort of . Can I expect any thing good in life. If my parents wont support me as they have 2 floors separately . I am the legal heir of atleast 1 floor, nothing else expected, but it will just help me as a fix deposit in my old age. Any thing I can do to stop such possibilities. pls suggest?. they are well to do as my mother is retired from a govt Job. Father is having FD from his job.I am having loans to pay. But they never ever asked if any help required. Even they know abt my second husband taking no responsibilities of me and my kids.

If the property comes under the self acquired category of your patents then they are absolute owner of that property and fry can give the entire property to anyone in the world and u don’t have any rights to object then nor u can’t do anything. Instead of expecting from them rather u should have taken proper care of them so that u must have good relations.

If the properties of your parents, as mentioned above, are self acquired then they can give the said properties to anybody by their free will any you cannot object to the same. But I’ll rather advice you to seek maintenance from your husband as he is obligated to maintain you and your children as per the provisions of laws.

For any further legal assistance please feel free to contact.

Hi

If the property is self acquired by your parents and they have a will, there is less possibilities for you to demand anything.

Though if it’s ancestral, you have a right in it.

If it’s self acquired and your parents pass away without leaving a will, you again half a 50% right in it.

The same goes for other assets like FD etc.
