My father a retired chief engineer recently passed away. My mother housewife with no income throughout her life. All self aquired property of father but some title held in my mother's name which was purchased by my father. My mother is interested secretly in giving bigger share to my 2 other brothers. Q1 Do I have a share in all Self aquired property of my father regardless that my mother is title holder in some.Q2 how do I get A restraining order or injunction on fixed deposits of my father who is no more. My father passed and we are survived by 4 brothers and mother. Since there is lack of unity and two brothers are working in collusion with the mother to grab bigger share.
You have share in self acquired property of your father because after the death of your father the property has become Joint family property now some property is in name of your mother so she’s the title holder and she can dispose the property according to her will you can’t claim it unless and until you prove that this was purchased by my father and it should also be treated as joint family property.
Now as regards the fixed deposit of your father you can write an application to the bank manager of the branch where the deposit was kept by your father and you can mention that I am also one of the legal heirs and I am also having Share in the fixed deposit.
Injunction order can only be given by court and not by any authority or bank once you file suit for partition you can claim for injunction also
