Legal Procedure to obtain a succession certificate

My father passed away in Feb, 2016. He has a flat in Thiruvanmiyur where my mother is living at present . I, being son is living in Bangalore. I prefer to obtain a proper succession certificate. What is the procedure which I should follow ?

There are two ways to obtain it:-
a)Legal heir certificate-:- This is issued by Tahsildar. You have to approach Velachery Taluk office which is the Taluk office for Thiruvanmiyur and apply to the Tahsildar for legal heir certificate by mentioning your name and your mother's name as legal heirs. Along with the application, you have to attach address proof, Id proof, ration card, death certificate and any other document that may be required by Taluk office. After submitting the application the Revenue Inspector will come for an inspection to the local address and conduct an inquiry and thereafter legal heir certificate will be issued.

c) Succession certificate:- You have to approach the city civil court and file a succession original petition before the Court. You will need the assistance of a lawyer for this.

Generally if any person died without any intestate we have obtain legal heir certificate from the concern taluk office, we have submit application before the Revenue Inspector, He will inspect and submit report to thasildhar, If any clarification requires they will call you for enquiry and finally you will get legal heir certificate.

Hello, it is nothing but you have to approach the court within the jurisdiction of your father lived in. The death certificate and Legal Heir ship certificate and other relevant details of the property and any other assets or his bank account details have to be furnished while applying for the succession certificate, but it is not necessary. Also you have to pay required stamp duty to be paid. Pls contact me if you have further doubt in this regard. Thanks

you must apply for succession certificate from madras high court for the properties debts and securities of the deceased person with proper proof of legal heirs. The high court after following its procedure will grant succession certificate.

Sir,
Succession Certificate is issued by the court of law. A petition under Sec. 372 of the Indian Succession Act has to be filed. You and your sister will be petitioners and since there is no one to question the title of you both, there would be no Respondents.

Once the evidence is let in and arguments are heard court would issue Succession Certificate.
