land acquisition by government
06-Jul-2023 (In Property Law)
My father's ancestors land is going to be aquired by government.I am his daughter and married. My brothers and father has decided to not give me share in compensastion provided by government on aquired land.As compensastion ammount is in 10-12 crore.
I want to know. can i claim my share?if yes, what will be the procedure.
Yes Yes definitely you have a share in the property since it is an ancestral property. You have a legitimate right in that property and without your consent that cannot be even sold off.
We can start by sending them a Legal Notice for taking our consent and apportioning our shares to us.
If that fails, we can immediately move to court by filing O39 R1 application as well as filing a suit. By doing this you won’t be alienated from the property.
Thanks. We can discuss it properly over call.
Thanks
Yes, you can claim your share in the ancestral property under the Hindu Succession act. Neither your father nor your brother can stop you from claiming your share. You can file a partition suit for the same before the court of law for claiming your share in the said property.
For any further discussion please feel free to contact.
Thank you.
