Issue of property related to father's property

My issue is , my father property is in unregistered area . There is no legalized documents of that property. As a daughter. I want my share of property . But my father is no more now ..After the death of my father . My brother's are not ready to give me my legal right ..

The National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019 on 4th December 2019. The Bill received the assent of the President on 11th December and has taken the form of an Act.

The rights of ownership or transfer or mortgage to the people living in these colonies shall be granted on the basis of Power of Attorney, Agreement to Sale, Will, possession letter or any other documents including Payment documents. Any resident of an unauthorised colony in possession of the above mentioned documents will be eligible for getting ownership rights through conveyance deed or authorization slip.

If you have any of the above mentioned documents you can apply for conveyance deed or Authorization slip and acquire ownership rights over the property.

What exactly is your question ?.

You need to specify what do you mean by “ unregistered area” as such words is not defined anywhere in the law.

Second, the status of the property like how it was acquired by your father.

Then you can proceed further.

That as you are your fathers child you can file a suit for partition based on this fact and even you dont have documents court will ask your brother to provide documents so mere not having of documents did not stopd you from taking your share

Firstly, we need to understand what exactly do you mean by ‘unregistered property’, I would like you to share more details with regard to the same.

Secondly, as far as it is concerned with your right in your father’s property, then in that case, you have an equal right in your father’s property, if he died intestate i.e., without any will. So you can claim your right in your father’s property.

Even if the property is at an unregistered area that does not mean that property does not belong to your father ….your father must have purchased it via GP or another document …even if not then also he might have electricity, water bill and other house tax receipts in his favour …so you have to file suit for partition because you are one of the legal heirs in the property …please be in touch
