How to prevent a person from demolishing my property

15-May-2023 (In Property Law)
Sir, I am a sgebait of a debottor estate having 7 bibhas land with 2 big buildings. Our family private ltd company factory used up one building and was having tenancy status. This company was under lockout for 25 years. One sheba it recently without informing others dismantled and sold the metal items worth 50 lacks. Now he is demolishing small structures, cutting off all adult trees and planning to let out for warehouse to small traders. He has taken help from local club and scrap dealer who are known whooligans. Since the electricity is disconnected for unpaid dues, he has taken connection from a buster neighbour. We have lodged complaint to police, informed CESC. Police is not taking action, they have termed the issue as civil matter. CESC has also not disconnected ekectricity after 6 days of complaint. We would file a case u/s 144 crpc. How do we prevent him from letting out the property or demolishing the structures. Metal objects have already gone and some unpaid workmen paid.

First of all you have to lodge a complaint in written in the local Police Station and have to receive an acknowledgement from there. After that you have to move forward for a case u/s 144 crpc and have to take the injunction from criminal court temporarily. Thereafter you have to file a civil suit in the competent civil court in order to obtain the injunction till the matter or suit is disposed off.
