How to claim property of my father in his ancestral property

property is on my grandmothers name.my father is four brother but now my father is no more.how can i get my fathers hissa on my mothers name??

As per property right u have right to claim stake of ur father as ancestral property can be claimed by the successor son. U have to apply before district Court asking for legally granting ur rights in such.

Grandmother's property, after her death devloves upon all legal heirs including your father, if there is no legal document to the contrary. After death of your father, your mother and all his children are entitled to equal share totalling to his share in the property. You can issue your relatives a legal notice calling upon them to partition the property.

Venerated Sir, Under Sucession Act you have right to claim your father's share from other uncles and if they will deny then file partition suit and claim your right. Property should be ancestral property. Feel free to call and give feedback.

You have not disclosed as to which religion or caste you belong every religion and caste they have different way and methods of inherent succession and partition therefore until and unless you disclosed the same further it can’t be advised
