Given fullpayment to buy a shop the man still refuses to register it

27-Aug-2023 (In Property Law)
Hello I have given 100% payment to the person to buy a shop. The chain of the shop and all the other legal documents even the possession of the shop is with me which he gave me willingly after taking the full payment. But now he refuses to register the property and says he doesn’t want to sell his shop and says he will do a court case on me that I have committed fraud with him. I have all the recordings of him taking the money. He has blocked my phone number, has wrong address on his adhere card. To compile it all up. The person took 100% of my money and now refuses to register the property on my name. What legal action should I take? And if the case goes to court, who is going to win? Please explain

You have an option to file a police complaint for criminal breach of trust and cheating. Further you should file a Suit for Specific Performance wherein the court will direct the seller to Perform its obligation and get the registry done. You may consult

According to the information provided, you can sue the defaulting party for the specific performance and in order to proceed with the same, we first have to send a legal notice to the defaulting party with an immediate effect.

But for more elaborated and precise advice you need to share some more information with regard to the said case.

Please feel free to contact for further legal assistance.

Hi,

You can file suit for specific performance,
The other party will have to transfer the property in your name if you have all the proof of payment and the transaction is genuine .

Thanks and regards
