Gift deed time limit for challenging it
13-Jan-2023 (In Property Law)
My distant aunt has through gift deed transferred me her flat , this was legally registered, can her brother in law , i.e her desceased husbands brother challenge it.
This is my response to you:
1. If the property was self-acquired and the Gift Deed was given out of free will and it was registered then you are the owner;
2. If it was ancestral property then his claim can be there;
3. The person can file a claim within 12 years of first finding out as per limitation act;
4. Consult a local lawyer and take steps.
