Friend not paying the loan amount for the vehicle.

I took loan on my name and given car to my friend later me and my friend made a NOTARY saying that he has given all the money to me and i have received, this we did because if any accidents were happen so my friend will only be responsible and am not, but in really he didn't given me single rupee also. after 1 1/2 yr he is not paying EMIs and i took the car from him, now he is saying i have NOTARY with me i can do what ever i can do. Is that notart valid till date and can he take any action against me on that.
Yes, the agreement is valid. but in the agreement attested by a notary what is the mode of payment mentioned. in case of cash mentioned in it then you cannot do anything. in case its by cheque/ NEFT then by proving that no such transaction is there in the bank.
