I have my own shop at Malad West and society collect maintenance as per sqft base but society's act it should be in per unit base.so what is legal steps I want to challenge my socoity for my rights? Please help me and suggest legal fights against my society.committee doing his own law and self decided rules.
This is my response to you:
1. You will be bound the society laws, rules and bye-laws;
2. You will be bound by MOFA (if in housing) and also Maharashtra Co-op Hsg. Society Bye Laws;
3. You will need to discuss the matter further;
4. A close reading of your society bye laws need to be done;
5. You can first send them a legal notice;
6. If disputes do not get resolved then Registrar;
7. Last option is to approach High Court.
