Father died in 1990 what rights does married daughter have in property

Hi, I am posting on behalf of my mother who wants to fight for her property rights with her brothers...In her case her father died in 1990... Just wanted to know if she is eligible for her rights? And whats the way to fight forward?

Father died without execution of any will then property will treat as parental property and married daughter has equal property as son. she should go to mutation her name of property before competent authority.

Yes your mother has equal right in the property her father left behind, as compared to other children, further if with consent or legal notice the share is given, then fit and fine or else file a civil suit for getting your right/share

Since your grandfather passed away in 1990, and daughters have got the right to family property of their parents only since 2005 by the amendment in law, you mother does not have a legal right in her fathers property, however if your grandfather has expressed a will that the property be given to your mother in that case your mother can claim the property. The above is based on the presumption that you belong to a Hindu Family, in case you are a non hindu then the response will differ.

It depends whether your father have executed any will before the death after year 2005 the woman had given the right in the property of their father,, so far father advice and better answer please contact us
