fake stamp paper in property sale deed

29-Aug-2023 (In Property Law)
In 1963 and 1966, my brother and I sold two properties. The buyer used fake Rs1000 NJ stamp paper for both sales obtained from the Madras sub-treasurey and not a stamp vendor and registered the sale deeds with the sub registrar. This year India secruty press informed us that Rs1000 NJSP was printed only in 1977. Also, as we needed permission for this sale from our sisters, the buyer faked two release deeds “signed” in their names. The property remains vacant to this day. Can we file a cheating case against the buyer and his family and recover the property?

Yes, you may file a criminal complaint against the buyer for fraud and cheating at the proper police station, in consultation with a local lawyer. However, availability of limitation has to be ensured for initiating legal action.
