Division of parental property after free hold

Hi. My father were 3 brothers. Registry of the parental house had the names of all 3 of them until 2nd one passed away. After that, name of his son was added to the registry and the property was made freehold. Now all the three parties live on Separate floors but do not have individual registry. Also there is 1/3rd share in roof of each party or to say 1/3rd share in the entire property. The eldest brother and the son of 2nd brother are not ready for family agreement deed. My question is how to register the floor in individual’s name while securing the 1/3 rd share in roof.

file a partition suit on the property. once that is filed, the court will partition the property by metes and bounds demarcating everyone's share. once that is done, your problem is solved and then you can get the registry done.
