Deceased Fathers Name not in Ancestral Property

Our Ancestral Home is DDA registered under my Grandmother's Name although actually it was a joint ownership purchased by My father and Grandmother. The Share certificate also has joint ownership.. However now my Grandmother is very old and our Bua( Father's Sister) has made a false will and put herself as wrongfull heir to the Property. What can we do to protect our share of the property. We are living in the same house for 20 years. In case Grandmother dies can we fight the case

yes we can always protect the share, but for that we need to go through the entire set of documents to understand the title of your property. orally the facts can be different and our understanding may be different from the physical file.

Since the property is in joint name the same would not be an ancestral property it Would be a self acquired property. Would be prudent for you to seek a detailed legal Consultation for your legal issue. Get the title documents and Will legally perused from an Advocate

If your grandmother is still alive then u must make a n immediate move to hire an advocate and either get a registered will or gift deed for her share ! U must do this expeditiously and also collect evidences that the funds at gg time of purchasing the Propety was paid by your father Plz b in touch

when did you find out aboutthe will? The said WILL will come into play only after her demise. The option is to challenge the Will, but that's an uphill battle, its better to file a suit for declaration immediately to avoid future battles. This will ensure that the right title of the property is decided now itself instead of waiting to challenge the Will in future.
