Construction of one store room on roof having roof rights in builder f

29-Aug-2023 (In Property Law)
We have recently bought a 3rd floor with roof rights in Ranjit nagar, New Delhi. It is a builder floor. The building has mcd approved map and has parking, upper ground, first, second and third floor. I, having roof rights wanted to construct a small store room on roof. I wanted to know of it is legal ? I see major construction on roof on 3rd floor of flats all around me. But I just want to construct a small 7ft by 10 ft store room and a 5ft by 5ft toilet on a 150 yard roof.

You can construct a small store over your roof if you have good relations with your neighbours if you feel they would not object, but I doubt it will be legal. Any construction has to be approved by the MCD which includes its site map irrespective of roof rights. Moreover, you have to go through the sale deed and see if roof rights also includes right to construct. Another thing is, roof rights does not bar your neighbours to access the roof for water tanks and other utilities installed on the roof.
