Transfer of roof rights to the owner of 3rd floorloor

Whether the builder can sell/transfer roof rights to the owner of third floor n the owner can put lock on the door of terrace. Rights of the owners of UG IST N 2ndfloors. The building has been constructed by private builder which consists of common parking space, stars n lift with 1/4 share in land

Any part or possession of any property can only be sold or transferred by the owner of that property only. If the builder has the ownership or acting as a power of attorney for the owner then only he can sell or transfer the roof rights or any portion. Yes, the builder being the owner of this private building can sell or transfer any part of this building to any other person. The Builder has a full legal right to do so.

The deed has to be seen whether such owners have been given rights or not to go to the terrace for any purpose. Generally, they are given rights to go to terrace for some limited purpose which are necessary for daily routine. Please check the deed accordingly.
