Can i rent a property and then give it on rent in Delhi

29-Sep-2023 (In Property Law)
I'm a Hindu. I want to take a apartment on rent and then give the same apartment to someone else on rent. Is that possible to do in Delhi ? And also I want to do that with two or more apartments ? Now of course I'll take care of the apartments and clean them up, keep them in optimal condition for the guests and tenants. My landlord will just give me the keys and take his rent, that all will be his part. Rest of the stuff and headaches will be mine and also the profit (if I make any) will be mine. My question is would that all be legal ???

Hi,
You are talking about subleting.
You need to have a mutual understanding with your landlord and need to get a memorandum of understanding papers executed for same.

It cannot be legal context as rent laws doesnot permit. You have necessary changes in rent agreement with the owner regarding leasing property again. Once there is mutual understanding then it will be no problem for u

It is Legal if the sub let clause is mentioned in your rent agreement with your landlord
In your rent agreement with further tenant you must mention that you are executing the document as per the clauses of your rent agreement with your landlord

Yes! It is possible with the prior consent with your landlord under the agreement, without consent you cannot sub-lease the said apartment. Anything you want to do beyond such agreement you have to take prior permission

It is known as sub tenancy. You can do so but for that u need to take permission from your landlord. Whenever you take a flat/room/floor on rent you enter into a rent agreement with the landlord. Generally landlords don't include sub tenancy clause in the agreement. Convince your landlord to allow sub tenancy and also discuss the terms and conditions with him.
