Yes they can claim but there are several provisions under law but if your mother directly gift or make a deed in favour of ur wife or directly transfer the property then your brothers cannot claim but if your mother doesnt transfer in future unclaimed property can be claimed by all of your blood relative members under indian succession act

If ur mother will execute a registered gift deed in fabour of ur wife than u will to pay specific ammount toward revenue and ur wife will become owner of such land. After this process ur brothers can not claimed on that property on basis of patrimony.

Plz tell me the nature of land that land is agricultural or non agricultural. And you pay the consideration of land and make land owner your mother. Then you want your mother gift that property in your wife name is legal and your brother can not claim that property

आपने अपने माता जी के नाम 1 प्लाट खरीदा है और अब आप चाहते हैं कि उस प्लाट को आपकी मां आपकी पत्नी के नाम गिफ्ट कर देवें। आपका प्रश्न यह है कि अगर वह हमारी पत्नी को उक्त प्लाट गिफ्ट करती हैं तो क्या हमारे भाई उस जमीन के विभाजन का दावा कर सकते हैं या नहीं । इसका उत्तर है कि वर्तमान समय में उक्त जमीन की स्वामिनी आपकी माताजी हैं । आप की माता जी अपने जीवनकाल में जिसे भी चाहें उसे वह जमीन गिफ्ट कर सकती हैं बेच सकती हैं किंतु यदि उनकी मृत्यु हो जाती है और वह जमीन उनके नाम ही रहती है अर्थात उक्त जमीन को आप की माता जी के द्वारा किसी को न गिफ्ट किया गया है नहीं बेचा गया है तो ऐसी स्थिति में आपके भाई उस जमीन पर विभाजन का दावा कर सकते हैं।
